1. Definitions

  1. “Company” refers to Pure IT Recycling Ltd, trading as pure IT & Pure IT Refurbished.
  2. “Customer” refers to the entity purchasing products directly from the Company, excluding online transactions.
  3. “Products” encompass refurbished IT equipment, including computers, laptops, monitors, and related accessories.
  4. “Contract” denotes the agreement between the Company and the Customer for the sale of Products, governed by these Terms.

2. Scope

  1. These Terms apply exclusively to offline/direct sales conducted through our sales team. They do not apply to purchases made via our website, which are governed by separate terms available at www.pureitrefurbished.co.uk/terms-conditions/.

3. Orders and Acceptance

  1. All orders must be submitted in writing, either via official purchase orders or email, and are subject to acceptance by the Company.
  2. A binding Contract is formed only upon the Company’s written confirmation or dispatch of the Products.

4. Pricing and Quotations

  1. Prices are exclusive of VAT and any applicable delivery charges unless stated otherwise.
  2. Quotations are valid for 30 days from the date of issue, unless specified differently.
  3. The Company reserves the right to adjust prices due to changes in costs or errors in pricing.

5. Payment Terms

  1. Public sector organisations are granted 14-day credit terms from the date of invoice.
  2. All other customers are required to make full payment prior to dispatch, unless alternative arrangements are agreed upon in writing.
  3. Payments should be made via bank transfer to the account details provided on the invoice.
  4. Late payments may incur interest charges in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

6. Retention of Title

  1. Ownership of the Products remains with the Company until full payment is received.
  2. Until ownership transfers:
    • The Customer must not resell or dispose of the Products.
    • The Company reserves the right to enter the Customer’s premises to repossess unpaid Products.

7. Delivery

  1. Delivery dates are estimates and not guaranteed.
  2. The Company is not liable for delays caused by events beyond its control.
  3. Risk transfers to the Customer upon delivery.

8. Returns and Cancellations

  1. Returns are accepted within 14 days of delivery, subject to the Company’s discretion.
  2. Products must be returned in their original condition and packaging.
  3. A restocking fee of up to 25% may apply.
  4. Customised or specially ordered items are non-returnable.

9. Warranty

  1. Hardware: Full coverage of the device’s hardware and accessories, including but not limited to power cables, chargers, keyboards, and mice.
  2. Faults: Both partial faults that impair the functionality of the device and total hardware failures.
  3. Cosmetic Damage: Case damage that has not resulted from user negligence or mishandling.
  4. Electrical and Component Failures: Faults caused by component or electrical issues unrelated to user damage.
  5. Warranty length will be clearly stated at the time of quoting, at the point of purchase, or in the order confirmation.
  6. Standard warranty durations range from 3 to 5 years for mainline products.
  7. Laptop batteries are covered for 1 year, regardless of the hardware warranty length.
  8. To raise a claim, visit https://newportal.pure-services.co.uk/tsr.
  9. Identify the device by the 6-digit pure IT number (on a white sticker) and include it with your claim.
  10. Complete and submit the support form or email support@pureitrefurbished.co.uk or call 0131 337 9298.
  11. Initial response within 4 working hours; aim for resolution or replacement by the next business day.
  12. Exclusions: Accidental damage and software issues not caused by hardware failure are not covered.

10. Liability

  1. The Company’s liability is limited to the replacement or repair of defective Products or a refund of the purchase price.
  2. The Company is not liable for indirect, incidental, or consequential damages.
  3. Nothing in these Terms limits liability for death or personal injury caused by negligence.

11. Divisibility Clause

  1. Each delivery or instalment under the Contract is considered a separate transaction.
  2. Failure to deliver any instalment does not entitle the Customer to repudiate the entire Contract.

12. Force Majeure

  1. The Company is not liable for delays or failures due to events beyond its reasonable control, including but not limited to natural disasters, strikes, or transportation issues.

13. Governing Law and Jurisdiction

  1. These Terms are governed by Scots law.
  2. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
